Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Toyflix India service, operated by Sublet Solutions Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at B2/3, GEF block, Rajajinagar Industrial Town, Bangalore 560010 ("Toyflix", "we", "us", or "our"). By creating an account, subscribing to a plan, or otherwise using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. The Service

Toyflix is a subscription-based toy rental service. Subscribers receive a curated box of toys ("Toy Box") at regular intervals based on the plan they choose. Toys remain the property of Sublet Solutions Private Limited at all times and are loaned to the subscriber for the duration of the subscription cycle.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract under Indian law to subscribe to the Service. Toys are intended for use by children under the supervision of a parent or guardian. The subscriber is responsible for ensuring age-appropriate use.

3. Account Registration

To use the Service you must register an account with accurate personal information, including name, phone number, email, and delivery address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at customersupport@toyflix.in if you suspect unauthorised access.

4. Subscription, Billing and Renewal

• Plans: Plan details, pricing, and toy quantities are listed on our pricing page at the time of purchase.
• Billing cycle: Subscriptions are billed in advance for each cycle (monthly or as per the plan chosen).
• Auto-renewal: Subscriptions renew automatically at the start of each cycle using the payment method on file unless cancelled before the renewal date.
• Payment processing: Payments are processed by Razorpay. Card details are tokenised and stored by Razorpay, not by Toyflix.
• Taxes: Prices are inclusive of applicable GST unless stated otherwise. Tax invoices are issued in the name registered to the account.
• Failed payments: If a renewal payment fails, we will attempt to retry over 3 days and notify you. If payment cannot be collected, your subscription will be paused.

5. Cancellation and Refunds

Cancellation and refund terms are governed by our Refund and Cancellation Policy, which forms part of these Terms.

6. Delivery, Returns, and Toy Condition

• Delivery: Toy Boxes are delivered to the address on file by our delivery partners. Delivery timelines are estimates; we are not liable for delays caused by carriers or events outside our control.
• Return: At the end of each cycle, toys must be returned to our delivery partner during the scheduled pickup window. Toys must be returned in the same condition received, except for normal play wear.
• Cleaning and hygiene: All toys are cleaned and sanitised between subscribers under our hygiene protocol.
• Damage: Minor wear and tear from normal play is expected and not charged. Significant damage, loss, or non-return of toys may attract replacement charges as detailed in the Refund and Cancellation Policy.
• Late return: Toys not returned within 7 days of the scheduled pickup may attract a late-return fee of ₹100 per toy per week, or the replacement value of the toy, whichever is lower.

7. Subscriber Obligations

You agree to:

• Provide accurate information and keep it up to date.
• Use the toys for their intended purpose under appropriate adult supervision.
• Not modify, sell, sub-lease, or transfer toys to any third party.
• Return all toys at the end of each cycle in line with these Terms.
• Promptly notify us of damage, loss, or safety concerns regarding any toy.

8. Toy Safety

Despite our best efforts, toys carry inherent safety risks especially for children under three years of age. Toys must be used only under adult supervision and according to the age range and instructions provided. If you notice any broken parts, sharp edges, or hazards, stop using the toy immediately and contact us. Toyflix is not liable for injuries arising from use of toys without adequate supervision or contrary to the provided guidance.

9. WhatsApp and Other Communications

By subscribing, you agree to receive operational communications from us about your account, subscription, and orders by email, push notification, SMS, and WhatsApp at the number registered to your account. Promotional communications are sent only with your explicit opt-in and you may withdraw consent at any time as set out in our Privacy Policy.

10. Intellectual Property

All content on the Service — including the Toyflix name, logo, website, app, photos, copy, and curation choices — is owned by Sublet Solutions Private Limited or its licensors. You may not copy, reproduce, modify, or distribute any of this content without prior written permission.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Toyflix is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our aggregate liability to you in connection with the Service shall not exceed the amount paid by you to Toyflix in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Suspension and Termination

We may suspend or terminate your account if you breach these Terms, fail to pay, repeatedly damage or fail to return toys, or use the Service in a manner that we reasonably believe is fraudulent or harmful. We will give you reasonable notice where possible and an opportunity to remedy the breach.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to you by email or via a notice in the app at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at Bangalore, India.

Before initiating any legal proceeding, you agree to first attempt to resolve the dispute by writing to our Grievance Officer at customersupport@toyflix.in, who will respond within 7 business days.
